You must use EU Rights to use EU law to get Citzenship

In a press release issued on the 5th of May, the European Court of Justice gave notice of a decision issued by the Court on that date.

The position is that Ms. McCarthy, born in the United Kingdom, married a Jamaican man and then sought to apply for and Irish Passport, which she received. She then applied to the United Kingdom for a residency permit as an Irish Citizen.

Her husband subsequently sought to rely on EU rights allowing the spouse of a Eu Citizen to reside with their spouse.

The Court held that this was a case where there had been no exercise of any Treaty Rights, such as movement, and that as a result, the question was one of National Law rather than EU Law.
